Schwab Motion Denied Execution Scheduled For November

The man on death row for raping and murdering a Brevard County boy will be executed later this year as planned, despite his attorneys' appeals.

Lawyers for Mark Dean Schwab had been arguing their client suffered from a brain impairment, which made his death sentence unconstitutional.

They also raised questions about Florida's lethal injection procedures.

However, Sunday we learned a judge denied the motion.

Schwab has spent more than a decade in prison after the 1991 kidnapping, rape and murder of 11-year-old Junny Rios Martinez in Cocoa.

His execution is scheduled for November
