Doug Berman & Prawfsblog are hitting home runs on the issue of what Cunningham v. California means. Long story short, in any state where the jury doesn’t have the final say in sentencing, capital or noncapital make your objection, preserve your record, and continue raising on appeal. Ummm, and if you can explain to me how Alabama & Florida’s scheme survive, or how the noncapital schemes in states other than California fared after Monday, please let us all know.
