No word from US 6th Circuit on appeal of Biros stay of execution

No word from US 6th Circuit on appeal of Biros stay of execution:

There has been no response yet from the US 6th Circuit Court of Appeals to the Ohio attorney general's appeal of the US district court stay of Kenneth Biros' Jan 23 execution currently still in effect. This means that - absent a move by Governor Strickland to announce a delay of the execution without waiting for the courts to come to a final resolution - there is now a good possibility that court appeals (e.g., an appeal for a 6th Cir en banc reconsideration after the 3-judge panel's ruling, and a cert. petition to the US Sup Ct.) will extend through the weekend and perhaps not be resolved until some time on Monday, or even possibly Tuesday morning.
