Hearing set in local case challenging lethal injection

ELYRIA - The Ohio Department of Rehabilitation and Correction submitted to Lorain County Common Pleas Court Judge James Burge a voluminous binder of information this morning about how the state conducts executions by lethal injection.

Two Lorain County criminal defendants who have not yet gone to trial but potentially face the death penalty have argued in Burge's court that the state's method of lethal injection is cruel and unusual punishment.

Burge said a status conference on the case will likely occur in a few weeks followed by a hearing with expert witnesses for both the parties who are challenging the death penalty and the state of Ohio.
