Judge Grants Henderson Stay Of Execution Till June

(CBS 42) AUSTIN Monday a judge agreed to convicted murderer Cathy Lynn Henderson's request for a stay of execution. Henderson was scheduled to be executed April 18, but the date has now been pushed to June 13.

299th Circuit Court Judge Jon Wisser said in a statement that though he was "not convinced of the legal correctness of the defendant's position" it was "in the interest of justice" to grant a stay to allow the defense enough time to perfect its appeal.

Henderson's Attorney Jani Maselli asked the court Friday for a 90-day stay. Maselli said she believes recent technology for babies with head trauma could have saved Baugh's life, and planned to appeal on the basis of this research. The stay granted Monday is for 56 days after the original date.

Henderson was convicted of the 1994 murder of 3-month-old Pflugerville baby Brandon Baugh. Henderson said Baugh died in an accidental fall and that she panicked and then buried his body in a field near Temple before leaving the state. Medical examiners said Baugh's injuries were inconsistent with a fall.
