South Dakota Legislature to Debate Lethal Injection & Abolition Bills Tomorrow

South Dakota Legislature to Debate Lethal Injection & Abolition Bills Tomorrow

The South Dakota legislature has scheduled a public hearing before the House State Affairs Committee for three bills relating to the death penalty. Two of the bills attempt to revise South Dakota's lethal injection procedure so that executions can recommence, while the third (which has a twin in the Senate) calls for repeal of the death penalty in South Dakota. House Bill 1160 would repeal South Dakota's current requirement of a doctor's presence at an execution by lethal injection. House Bill 1175 would place the determination of the drugs to be used in a lethal injection in the hands of the warden, subject to approval by the secretary of corrections. The abolition bills (HB 195 and SB 161) would replace the death penalty with life imprisonment in future cases. They do not appear to have any retroactive effect on current death row inmates.
