ORDER
Appellant filed an application for leave to proceed on appeal in forma pauperis and a motion to place this case in abeyance and enjoin appellees from executing him on October 17, 2007, pending decision by the United States Supreme Court in Baze v. Rees, No. 07-5439. Appellees filed a response and supplemental response in opposition to the motion to place case in abeyance and to enjoin execution. Appellant filed supplemental authority and a reply in support of the motion.
The Court grants appellant leave to proceed in forma pauperis. The Court denies appellant's motion to place this case in abeyance and enjoin appellees from executing him on October 17, 2007, pending decision by the United States Supreme court in Baze v. Rees, No. 07-5439. Judge Gregory voted to grant appellant a stay of execution until the Supreme Court decides Baze v. Rees
