Indianapolis, IN (AHN) - A U.S. District Court judge in Indianapolis is being asked to consider the mental health of an inmate sentenced to death.
Defense attorneys for Norman Timberlake, 59, are filing a motion asking the court to declare the death row inmate insane after a previous appeal to the Indiana Supreme Court failed earlier this month.
Timberlake is scheduled to die by lethal injection on January 19, 2007, after he was found guilty of killing Indiana state trooper Michael Greene in 1993.
U.S. District Judge Richard Young gave the state until Friday to respond to the request for a stay on the insanity claim. The Indiana attorney general's office will oppose a stay, said spokeswoman Staci Schneider.
